1. Acceptance of Terms

By accessing or using Growka ("the Service") at growkalabs.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including free trial users and paying subscribers.

2. Description of Service

Growka is an AI-powered marketing platform that helps businesses create, schedule, and optimize content across social media channels. The Service includes AI content generation, automated publishing, analytics, and channel management tools.

3. Accounts and Subscriptions

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• Subscriptions are billed monthly and renew automatically unless cancelled.
• Credits are allocated monthly per plan and do not roll over to the next billing period.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

4. Acceptable Use

You agree not to use the Service to:

• Generate, publish, or distribute illegal, harmful, defamatory, or misleading content.
• Violate the terms of service of any connected social media platform (Facebook, Instagram, LinkedIn, X, TikTok, YouTube).
• Spam, harass, or engage in any form of automated mass messaging outside of legitimate marketing.
• Reverse engineer, scrape, or attempt to extract source code or data from the platform.
• Share your account credentials or resell access to the Service.
• Use the AI generation features to create content that impersonates individuals or organizations.

5. AI-Generated Content

The Service uses artificial intelligence to generate text, images, and other content. You acknowledge that:

• AI-generated content may not always be accurate, complete, or suitable for your purposes.
• You are solely responsible for reviewing, approving, and taking responsibility for any content published through the Service.
• You retain ownership of content you create and publish using the platform.
• Growka does not claim ownership of content generated on your behalf.

6. Social Media Platform Compliance

By connecting social media accounts, you authorize Growka to publish content on your behalf. You are responsible for ensuring that your content and publishing activity complies with the terms of each connected platform. Growka is not liable for account suspensions, restrictions, or penalties imposed by social media platforms due to your content or publishing frequency.

7. Credits and Billing

• Each plan includes a monthly credit allocation. Credits are consumed per content action (text posts, images, videos, etc.).
• Unused credits expire at the end of each billing cycle and are not refunded.
• We reserve the right to adjust credit costs with 30 days' notice.
• Refunds are not provided for consumed credits or partial billing periods, except where required by applicable law.

8. Intellectual Property

The Growka platform, including its design, code, AI models, and proprietary workflows, is owned by Growka Labs and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without prior written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Growka and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid in the three months preceding the claim.

10. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will meet your specific requirements. Results from AI-generated marketing content may vary and are not guaranteed.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your access to the Service and generated content will cease. We will retain your data for 30 days following termination, after which it may be permanently deleted.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
